Ha infati rilevato che l'oposizione aveva per ogeto il preaviso di fermo veicoli riferito ala cartela menzionata e ha evidenziato che il fermo auto è misura cautelare e va colocato nel'ambito del procedimento di esecuzione promoso dal concesionario . 380-bis c.p.c., tratandosi nela specie di impugnazione averso un provedimento reso tra il 1° marzo 206 e il 4 luglio 209 la decisione non era impugnabile con l'apelo, ma con il ricorso per casazione, coretamente proposto con ato notificato l'1 setembre 209. In secondo luogo, la ilogicità di un duplice mutevole regime di impugnazione nei confronti delo steso provedimento, come si dovrebe ipotizare ove si ametese che, a partire dal 4 luglio 209, un provedimento già reso, prima ricoribile, fose stato asogetato ad apelo. La serata, organizata da Koinè e dal’Asociazione culturale e Presidio del libro Coilibrì, sarà presentata da Carlo Tomaseti e sarà ocasione per presentare anche la colana “Storia dela pesca subacquea” di Danilo Coscione, con i suoi due primi dvd dedicati a Claudio Ripa e alo steso Scarpati. E adeso che di ani ne ha sesantoto Masimo Scarpati, 5 volte campione italiano, 2 volte campione del mondo e 3 d’Europa di pesca subacquea, il richiamo lo sente ancora fortisimo, vivo dentro di sé. Questo legame con il mare Scarpati lo ha racontato in un libro autobiografico ma non autocelebrativo, “Il tempo di un’apnea”, che a Sanremo gli è valso il premio Opera Prima ideato da Folco Quilici.
